The United States Energy & Commerce Congressional Committee is discussing a draft bill they have entitled "The FDA Globalization Act of 2008".

While this discussion bill is not yet a formal bill, which can be voted into law, it addresses problems of food chain supply and consumer safety as it applies to drugs and cosmetics. It is expected to become a formal bill soon.

I am most concerned with this draft bill as it pertains to small businesses producing cosmetics such as lotions, lip balm, bath salts, shower gel, moisturizing soaps, etc.

If this bill becomes a law, as it is currently drafted, and you are producing cosmetics you will be required to:

    · Annually register your company with the FDA.
    · Pay a fee of $2,000 per year.
    · Register all ingredients in each of your individual formulas.
    · Document good manufacturing practices.
    · Report all adverse reactions.

I know the hardship this potential legislation will have on small businesses in our industry. Now is the time to act. This discussion bill is not a full bill. There is still time to have the language modified so that it does not interfere with your business, product innovation and the entrepreneurial spirit of the American Dream.

On September 24th, I will be making my first trip to Washington DC. I will be meeting with several people including Senator George Voinovich, Senator Sherrod Brown and Congresswoman Betty Sutton.

I need your help for this important visit. Please take the time to answer 10 important questions. I will be binding your answers into a book for presentation with additional support materials.

I will personally deliver your message to Washington on the 24th!

    Sincerely Yours,

  1. Hi,

It is working. I have had several hundred responses so far.

Make sure you are answering every field. If you leave a field blank, it will not allow you to go to the next question.

I would like to do the survey but would rather keep it anonymous. Is there any way of making it so we don't give them all the name, company, address etc. I'm sure I'm paranoid but it makes me fear that if they have all this we may be "watched".

  1. Hi,

Members of the US Congress and the US Senate need to hear your story. They need to see that their decision impacts real people, with real lives.

If was anonymous, they may wonder what someone is trying to hide. That could be misinterpreted. Of course, they don’t know me from Adam and might think that (without real names) I was making up stories.

I am a second generation homemade soapmaker I enjoy making my soaps and I sell at farmers markets the only complaint I have ever had was one lady said after she used the soap once, the fragrance went away.I gave her another bar and she went away happy. The aroma therapy helps me and others. I am bipolar with achd.
I do not make $2000 a year and would hate to have my own goverment tell me I can't do something that has been done for centuries so they can get more money from us. I do not force people to buy my soap and after they have tried a good bar a soap they usually come back

Thanks Deb for standing up for the small business owners. I feel very confidant in the products that I purchase from WSSP because you care enough to check into everything you sell. And you give us the information so we can pass it on to our customers. Why does the government have to interfere? I have no idea how the language of this bill can be changed but I have a feeling that you probably do. Thanks again for being our advocate!

This is very disturbing to me. I would be very interested to know who sponsored this potential bill and who is lobbying for it. It sounds like big business trying to squeeze out the little ones. So many questions. What is the fee for, who will be on the oversight committee, how will they oversee it. And what is all this about listing any adverse reactions. This certainly does not sound like it has anything to do with public safety. The negatives are endless and I can't think of one positive.
    Go get 'um Debbie!

  1. Good Morning,

If you have had trouble completing the survey, please try again. I changed some settings that may help.

    Thanks!

Thanks Debbie for taking such a proactive role! I too will have to stop selling my soap if this happens as I don't make much more than $2,000/year. It is such a blessing to make it at my leisure and get some extra money around the holidays or when we have a big bill due. I know some of my regular customers will really miss it as well.

Debbie, thank you for taking this on! (Yes,I did fill out your survey). I do agree that the FDA needs to step up their game to ensure a safe food source in this country. But I think this Globalization Act is too global! I'd rather see separate acts than to throw a blanket over everything. That said, if this passes as is, it'll put me out of business. I've invested 1000's in getting my business going but have only recovered 100's. I can not afford a $2000. fee. The fear of this even getting a foot hold has stopped me from expanding. I'm only ordering what I feel I will use in the very near future. I am no longer buying nearly as much as I was before and trying to sell what I have on hand. I was going to buy a travel trailer to turn into my shop, but will no longer do that either. Does this act sound like it'll help the economy with that said?
It's a shame that a few rotten apples has sparked this knee-jerked reaction. I'm thinking there are plenty of regulations on the FDA books that can keep our food safe if they'd just be more diligent on their inspections. The right to provide for one's self and family (and extended family) by making our own simple products may now be taken away. Sorry so long, just upset and very glad to have you on our side!
