Update: Non Certified EO Blends

Wholesale Supplies Plus has sold "non certified essential oil blends" for about 7 years. Over the past 18 months, we have shifted our expectations to selling only essential oil blends that have been certified as containing only 100% pure essential oils.

Unfortunately, the vendor that compounds our "non certified essential oil blends" continues to refuse to participate in our essential oil certification program. This has caused several problems in advancing our industry efforts for purity.

Therefore, I have elected to continue to offer these "non certified essential oil blends" but reclassify them as "fragrances containing essential oils". This new classification allows the oils to enjoy the federal trade secret status the compounder is claiming. The term fragrance simply means "aromatic compound".

As a result, we are having our own lab analysis performed on these oils. Certificates documenting the percentage of natural ingredients will be supplied online in the first quarter 2012.

WSP Discontinues Paraffin Waxes

Wholesale Supplies Plus would like to announce that it is discontinuing paraffin wax used in the production of handmade candles.

This decision has not come without much thought, discussion and contemplation. Frankly it is one of the hardest decisions I have made since starting the company in 1998.

I would expect that the first question asked is why. The answer is not that complicated and two fold.

First, our company has always been focused on providing only the highest quality supplies to our customers at the lowest possible price. Since IGI purchased BP and Honeywell, we have seen nothing but significant price increases and loss of distributor incentives. Over the past 14 months we have been asked to change how we do business and begin holding over $125,000 in inventory for margins that are far below any industry standard.

Second, our company was established with the philosophy that our customers seek to hand produce products that are better for themselves and those around them. We feel that carrying only soy wax for candle making better fits this philosophy. Buying and using soy wax from American-grown soybeans, it's biodegradable, a renewable resource, and from a global point of view supports the U.S. economy instead of foreign oil conglomerates.

For those customers regularly using paraffin wax: we have about a full truck of wax on our floor now and will not be discounting it. We expect it to last through the end of the year. When it is gone, we do not plan to restock it.

Emerging Issues Conference - Summary

This week I had the pleasure of attending an “Emerging Issues Conference” hosted by the Personal Product Council (PCPC). This has been the first PCPC conference I have attended so I wasn’t sure what to expect….I have to be honest….it was a very, very good conference.

Since I many people cannot attend this conference, I thought I would share key points presented by these experts. It is my hope that you can use some of the knowledge to grow and further your business!

California Green Chemistry Regulations

This was an excellent presentation given by Debbie Raphael, Director of the Department of Toxic Substances Control, California EPA.

Summary

Legislation is to be introduced into the State House end of October 2011 and is expected to pass, taking effect end of first quarter 2012. This legislation will create a final list of 200-500 “chemicals of concern” and their use in a specific application. They expect list to take a full 3 years to substantiate and populate. To begin they will take an accumulation of over 8,000 chemicals on different lists of concern. Ms. Raphael noted that she does not expect any of these to be surprising to industry experts. To narrow the list of 8,000 to under 500, the chemicals will then go through a two-step process. First they must be qualified with 3 basic questions: 1. Is the chemical currently legal? 2. Is the chemical safe? 3. Is the chemical necessary? Once a chemical meets those three questions, they will identify priority levels for an alternatives assessment. No chemical will be put on the “list of chemicals of concern” without an alternatives assessment.

The alternatives assessment will ask the following questions:

Will business be negatively impacted by placing this chemical on a list?
Is it practical to place the chemical on the list?
Is it meaningful to human health to have the ingredient on the list? There must be a “Human Exposure Pathway” to have a chemical placed on the list.
Can California legally defend placing this chemical on the list.

Chemicals on the list will then be given one of 8 responses to the alternative assessment. They range from: 1. No Action, 2. Additional Info Needed, 3. Product Warning Label, 4. Restricted Use, 5. Prohibited, 6. Limited Access, 7. Ban and 8. Other.

Debbie’s Thoughts

I was impressed with the level of thought that went into creating a list of chemicals of concern. As far as I am aware, this is the only state requiring an alternatives assessment. I was happy to see consideration was being given to how having a chemical on the list would impact products and business. This legislation is a big one and will cross many different industries. An exemption for cosmetics is desirable because in an ideal world, there would be one federal cosmetic ingredient list enforced by the FDA and not a patchwork of lists that differ state to state.

Consumer Perceptions and Behavior

This was a very good presentation by Amy Ziegler of Mintel Beauty and Personal Care Research Team.

Summary

Consumers overwhelmingly want to be educated about their purchases.
They want to support “Green Chemistry” but do not understand how they can support it.
They are seeking government regulations and more specifically a trusted government website they can access for valued information.
More and more customers are conducting their own research and not just believing claims.
Consumers care more about protecting health and safety of self and family when compared to reducing carbon footprint.
Industry growth areas include: Skincare, Color Cosmetics and Fragrance.
25% of those surveyed want an ingredient list for fragrance ingredients.
Growth is in NaTrue Certifications
Growth for Not Tested on Animal claims.
Decreased significance in claims for natural, organic, fragrance free and paraben free.

Look for companies to think out of the box and explore new applications in the technology that cross over for health and cosmetics. For example: A Smart Phone - Smart Sun Care App. Imagine if a company that manages lifeguards required employees use a smart phone application that recorded when they applied sunscreen and this lead to a decrease employee health care costs.

The discussion then turned to consumers and their willingness to pay more for “green chemistry” products. The feeling is that there is still a trend in which consumers will purchase more expensive products when they perceive the benefit relates to value. They will NOT turn to less expensive or equal products if it involves safety to themselves or family.

Debbie’s Thoughts

This talk confirmed what many in our industry already clearly understand. It reminded me how fortunate our industry is to have direct personal relationships with so many of our customers. …and our customers talk to us. The companies that most benefited from this discussion were likely large corporations that have no direct contact with their buyers.
Social Media – Media, Brand, Reputation Management

This was a very good talk given by Zackay Tindall from Edelman Digital.

Summary
Every company should be participating in 4 areas of digital media. They are:

An owned website.
Social media platforms which include at minimum: Facebook, Twitter, Linked In and YouTube.
Paid advertising – banners, ads, etc.
Earned advertising – news reports, articles and interviews

The trend in social media is to own a “hub” that has all of your company blog, newsletters, twitter, facebook, youtube and blog posts. Consumers are on information overload and want to go to only one place for information about your company.

Customers need to hear a message 3 to 5 times before they will start to believe it is true.

Google appears to highly rank articles or posts from NY Times, Yelp and Blogger.

Social sites will continue to grow but it is not clear how those will translate to sales. Instead they should focus on brand promotion.

In 2012 mobile and hand held devices (IPad) use will surpass laptop and desktop use for shopping and general internet surfing. It will be vital you develop a mobile website or at very least optimize your company website for mobile/hand held devices. Consumers remain uncomfortable placing credit card numbers on these mobile and hand held devices therefore it is anticipated PayPal will continue to grow as a payment method.

Look for company “opt in” options for company text messages. This is in relation to company coupon codes and special notices. The only thing currently holding back this trend is the lack of tracking systems for effectiveness.

Debbie’s Thoughts

I really liked this presentation. I would have liked to have sat next to him for lunch so that I could have asked him more questions….instead got to sit next to many legislative minds, which did make for good conversation on its own! In terms of social media, I think small businesses (which often work on a bootstrap budget) need balance time, costs and reward. I personally would like to see more data on the concept of creating communities where people can talk about whatever they want. I was recently at the Bare Escentuals Facebook page and can’t see how it translates to purchases or even brand promotion. In a full pages of posts only 2 were about products. The rest were spam, animal pictures or babies. I feel like I am missing something with the concept.

I like the idea of an “opt in” text message for coupon codes and big sales. I feel they would be annoying for things such as newsletters, blog posts and twitter feeds. I would think an app or email would be more ideal for that type of communication.

I really like the idea of creating a mobile optimized website. I have to wonder how this will translate to those who currently sell on etsy and ebay. Will it change images, descriptions and the way our industry currently markets to customers?

Extended Producer Responsibility

This was an excellent talk given by Brian Flaherty with Nestle Waters and Randy Pollack with the Law Office of Randy Waters.

Summary

“Extended Producer Responsibility” means that the company making a product is responsible for its after use environmental impact. The term coined is a manufacturer having responsibility “cradle to cradle”. In the 70’s some states enacted “Bottle Bills” these were to fund disposal or recycling. The new trend is for regulations that are much more strict and stress the reduction of waste. Every manufacturer will have a fee to produce “rigid packaging”. This fee will be realized by the consumer. Currently 1 state has already passed an EPR law, 17 states are considering introduction of a bill and over 30 states are formulating bills. This is an issue that will impact costs and still does not solve the issue that the as a national whole the consumer is not fully compliant with recycling. As a result of EPR efforts look for these trends: lighter packaging, 10% thinner bottles (think of the thinner plastic now used in water bottles), 50% Post Consumer Resin packaging, increase interest in glass.

Debbie’s Thoughts

Quite frankly…my only thoughts are…really…. more regulations that cost the consumer money? I like the idea of thinner bottles to reduce costs and 50% post-consumer resin packaging. I did get some feedback on how to maintain bottle clarity and color with post-consumer resin. I think that may be an area of growth for our industry.

Safe Cosmetic Alliance
This presentation was given by the Lezlee Westine – CEO of Personal Care Product Council, Pam Busiek – CEO of Independent Cosmetic Manufacturers and Distributors, Steve Sleeper – ED of Professional Beauty Association.

Summary

This was an excellent yet casual presentation. It was relaxed with lots of time for questions and answers. In light of the flurry of proposed legislation at the federal and state levels all three organizations feel it is better to have one clear and concise voice. The concept is they need to work collaboratively with one voice. Each partner brings different strengths and weaknesses to the table. The overwhelming message voiced was : “A Divided House Falls. Together We Are Stronger”.

Debbie’s Thoughts

Outside of the economy, I think needless legislation is single most dangerous topic that threatens our industry. I was glad to see multiple nonprofit agencies working collaboratively to present one voice to Washington. Unfortunately, they do not appear to have a clear understanding of our industry. They talk about small businesses being less than 5 million in sales. The needs of a 5 million dollar business are far different than those in our industry that are primarily under 100 thousand in sales. Sometimes I get so tired of talking to leaders that “don’t get it” or “don’t want to get it” or “feel we are too small to matter”…but I will keep plugging along. One way or another we will have our voices heard and our interests represented.

Navigating the Border Issues
This presentation was given in two parts. First was from a broker that specializes in import and export. The second part was from an FDA Inspector.

Summary

Approximately 2% of exports are held for inspection. To lessen your chance of inspection you need to include the following on your invoice or paperwork:

Country of Origin for each product.
Detailed explanation of the products intended use.
The Harmonized Tariff Code.
Price of Product in US Dollars.
A box number assigned to each product. For example if the shipment is 10 boxes, which exact box is a product located.
Certificate of Analysis for each product.
Ingredients for each product.
Intended age groups for each product.
Government agencies that manage each product. If four agencies may touch that product then you list all four. For example Goat Milk Lotion would have USDA and FDA.

You will need specific compliance and record keeping files. When they call asking for records, do not find yourself in the position of having to go through accounting records to find the answers to their questions.

A big message was: Do everything right the first time. Do not give inspectors a reason to open your shipment. Once you go through an inspection you may find you will go through future inspections because you have been flagged in the system.
The FDA presentation became very interesting when they talked about their focus for managing imports. They are currently managing with a 10% reduction in staffing. Their strategy is to become more proactive and targeting high risk products. They can inspect based on an “appearance standard” and “past violations”. They have four main targets for imports:

Eye area and mouth cosmetics.
Skin preparations in which there may be microbial growth.
Chemical hazards with packaging.
Unapproved color additives

The talk spent a significant amount of time on pearlescent pigments not being listed as a cosmetic color additive. Frankly, the whole room got confused and I can’t figure out what he was trying to communicate here. He did say that while INCI has nomenclature for colors such as Green 3, when exporting they want to FDC Green No. 3 because it provides the product approval.

Debbie’s Thoughts

I am not sure if I was tired but this speaker was a bit confusing at the end of the talk. I wanted to ask follow up questions but he had to leave. What I did take away is that exports are a wonderful growth area of our industry. For some time I have been told that people in countries throughout the Middle East, Russia and Japan find handmade products from the United States highly desirable. As a whole, our industry needs more guidance and help expanding into this area. This was a good start. I am going to do some digging so I can better help customers that want to export.

Conference Day 2 – Legislative & Government Affairs

The second day of this meeting was 100% government and legislative. It focused on state by state and federal legislative threats. I am not comfortable writing about the confidential details of that meeting. I can tell you that the issue of state and federal legislation is not going away….but it is not coming soon. It is a slow walk and not a sprint.
On the federal level, draft bills and proposed legislation are very active. I will continue to cultivate relationships, travel to Washington and provide a voice for our industry. Many in our industry are clearly misunderstood and under estimated by those in DC. Mistakes of our past are hurting us but in time I do feel progress can be made. When the time is right, I will provide additional legislative information via the blog.

Update on State of Massachusetts Bills: H01513 and H02361

Last week, I traveled to Boston for the purpose of meeting face to face with bill authors, legislators, committee members, and soap makers in our industry. I had four meetings and found each of them to be cooperative, positive and encouraging.

Life Center for Autism Foundation Announces Donation

Response To The Safe Cosmetics Act of 2011

Ÿ   I support safe cosmetics, the fundamental goals of this bill and phasing out harmful chemicals in cosmetics. I support the publication of available ingredient safety data for use by cosmetic manufacturers. I support placing the responsibility for ingredient safety testing on the companies that invent and manufacturer the ingredients.

Ÿ   I support the provisions the bill provides for micro and small businesses exemptions. It is important that new regulations do not create barriers for entering the industry and do not incidentally hurt small businesses already producing safe cosmetics. I personally thank the bill sponsors for listening to past concerns and including micro/small business exemptions in this legislation.

Ÿ   I will continue to work and educate committee members about our industry and how the details of this bill can be improved so that our industry and my customers are not inadvertently and/or negatively impacted.

Ÿ   I will continue to work with elected officials, their staff and officials at the FDA to identify the intent of the language of the bill so that only accurate and correct information is disseminated to our industry.

Ÿ   I will continue to travel to Washington DC and look forward to participating in future bill discussions and amendments with the House Energy & Commerce Committee and Members of Congress including the Sponsors of the Bill.

Ÿ   I support the work of The Handcrafted Soapmakers Guild (HSMG), a non profit trade association, who has worked tirelessly to maintain open lines of communication between elected officials and industry leaders so that the details of this bill can be improved for our industry.

I wanted to provide you with a brief but important update regarding customer service at Wholesale Supplies Plus.

As many of our customers are aware, Karen is our customer service and office manager. She has been with our company since 2001. What you may not know that Karen is also my mother.

Unfortunately, my mom had a heart attack at work yesterday and was taken to the hospital. She was stabilized quickly and is doing fairly well. Frankly, we are lucky to be located in Cleveland, Ohio with world class cardiac care. My mom will undergo triple bypass surgery on Friday and is expected to be off work for 6-8 weeks.

I know many customers call in with special circumstances and requests that Karen has handled for you. Often these are for pallet and international orders. Sometimes it is for a special payment requests. One of things Karen does best is making customers happy with the little things we don't even know about. While she is out, we want to continue her good work therefore....

Legislative Update

I am excited to make everyone aware of some very positive developments in our cosmetic legislative efforts.
While most of you are aware, in the past 5 years of working with legislators I have not supported the concept of any additional cosmetic legislation. The past six months of my meetings in Washington DC have caused me a fair amount of soul searching because it has become very obvious to me that at some point there will be additional cosmetic legislation. I have come to the conclusion that to really help the industry, my goals should be to not to completely oppose legislation but instead work with others to craft legislation that meets the needs of all parties while preserving our industry. My goal should be to help customers start businesses and stay in business.
With this in mind, I would like to give you an important legislative update:

New Legislative Bill

I have been informed that a new federal cosmetic legislative bill will be introduced into Congress very soon. I am told that the many provisions have been written into to the bill with the specific intention of protecting our industry. I would like to highlight three important areas.
1. Exemptions - Registration and Fees

Any cosmetic company that has gross aggregate under $2 million per year will be totally exempt from FDA registration, fees and the regulations contained in the bill.
Any cosmetic company that has gross aggregate sales between $2 million and $10 million per year will be required to annually register their company, facility and their product lines. They will be exempt from FDA registration fees.
Any cosmetic manufacturer that has gross aggregate sales over $10 million per year will be required to annually register their company, facility and product lines. They will be subject to sliding scale FDA registration fees.
Cosmetic companies that are required to annually register their business will not be asked to disclose formulas, suppliers, sales figures, employee information and confidential information. These companies will be asked to confirm the general types of products they manufacture such as lotions, shower gels, body wash, bath salts, etc. They will not be required to register each product name, lot or batch.
Any company that repackages cosmetic ingredients without changing the formula or chemical composition of the ingredient packaged will be exempt from the FDA registration, fees and the regulations contained in the bill. They will be required to pass along all manufacturer safety data, recommended use levels and regulatory information to the ingredient buyers.
The Food Drug and Cosmetic Act soap exemption will remain unchanged.

2. Ingredient Regulations

The FDA will have three categories for cosmetic ingredients: Safe without Limits, Restricted, and Prohibited.
All ingredients approved for food consumption will be in the category of “Safe without Limits”.
Botanicals will be in the category “Safe without Limits”.
Cosmetic ingredients on the “Restricted” list may be used in cosmetics but will have restrictions on usage or quantity. Examples may include safe for use at 1%.
Cosmetic ingredients on the “Prohibited list” will not be allowed to be used in cosmetics.
There will be no changes to the current cosmetic labeling regulations.
Additional safety testing and component analysis of ingredients by repackers and/or users of the cosmetic ingredients will not be required.

3. Small Business Assistance

The FDA will maintain an online site with updated information on the three categories of ingredients.
The FDA will develop a telephone hotline for small businesses to call with questions.

While there are nuisances of this bill to still be worked out, this new information makes me cautiously optimistic. I strongly feel that legislators in Washington DC now understand our industry and the exemptions included are intended to allow us to stay in business.
I fully anticipate that others will oppose this legislation. They will be critical of the general concepts, exemptions for our small businesses, registration fees for large companies and call into question parts of the draft bill that have yet to be specifically defined. They will do all of this to cast doubt to our industry all the while they plan on gaining support for another bill being circulated that benefits large companys and has no exemptions for us, clearly hurting our industry.
Therefore, I would like to take an official position on the information I have been given about the new bill being introduced into Congress very soon.
If what I have been told is actually in the bill and there are total legislative exemptions for our industry that remain unchanged through the committee process, I feel that this is a piece of legislation I can and would support. Under those conditions, I would also highly recommend that the over 80,000 customers from Wholesale Supplies Plus stand together in support the legislation. We need to be allowed to get back to work....growing our small businesses without fear of unnecessary government regulation.

Update: Basil Essential Oil

It has come to my attention that there has been a misinterpretation of my communication yesterday regarding WSP discontinuing its Basil Oil – Certified 100% Pure.

I believe in my attempt to make a brief statement of why the product was being discontinued, my statements were misquoted and repeated in an inaccurate manner to international members of IFRA, my professional colleagues and on Internet message boards. Therefore, I find the need to make this update statement.

What I wrote yesterday was: “We have been notified that per the updated IFRA Certificate (45th Edition) Basil Essential Oil is no longer approved for lotions, powders, soap and skincare products.”

I never said that there was a BAN on Basil Oil. This is absolutely not true. There is not a ban and I did not say that.

There are two types of Basil Oil and each has different levels of restricted ingredients which determines use level in different products. In addition, there diluted Basil Oils on the market being sold as Basil Oil that have a whole different set of use levels.

To fully understand the maximum use level for the Basil Oil you use, you must contact your supplier and obtain an updated IFRA certificate. Currently that certificate will be labeled 45th.

I personally spoke with Jennifer Abril, Executive Director IFRA North America from Washington DC and she confirms, “There is no IFRA ban on Basil Oil. Natural essential oils contain many components, some of which may be subject to IFRA restrictions.”

Dr. Frédéric Lebreux Scientific and Regulatory Affairs Manager, International Fragrance Association (IFRA) Brussels, Belgium states, "…by the way, we remind you that there are two types of basil essential oil (estragole type and linalool type). For your information, I reported below the main IFRA restricted ingredients of these oils. We advise you to consult the IFRA Standards related to the type of oil you use.

To help provide clarity to the restricted ingredients, Robert Tisserand gave me permission to quote him and states, “….basil oils can contain two constituents that are restricted by IFRA, estragole and methyleugenol. The level of restriction depends on the amount of these constituents.”

Therefore, I would like to clearly state the Basil Oil - Certified 100% Pure previously sold by Wholesale Supplies Plus clearly cannot be used in soaps, lotions and skincare products based on the most current IFRA 45th Amendment.

Project: Soap Petals

This is a great project for Mother's Day and Wedding Shower Favors. It is easy to make and takes less than 30 minutes to prepare before packaging. Soap Petals make an impressive gift!!

8 oz Crafter's Choice Crystal Clear Soap
7.5 ml Crafter's Choice Fresh Cut Roses
Silk Flower Petals from Michael's Craft Store
Wax Paper
Tweezers (to dip the petals)

Directions: Make soap and fragrance as directed. Dip petals and allow to dry on wax paper. Remove from wax paper and trim excess soap to shape of silk petal. Package as desired.

The petals can sit in a dish and be used as a highly scented room freshener. They can also be used for washing your hands. Simple add water, lather and dispose of the petal in the waste basket.
